As soon as you are facing financial hardship and your home is in danger, please put together all documents listed below to bring to your first meeting. The sooner you begin working to save your home, the easier it will be for us to be helpful to you.

The process is emotionally draining and frustrating. But the steps are necessary.

IMPORTANT: Do not pay anyone for their services, other than to fund a Forensic Audit (which will cost $300-$800). In California, is it now illegal to collect money to assist with loan modification.

Step-by-Step

  1. Home Save Considerations: What is best for you and your family
  2. Documents: You will need the documents listed on this link for ANY home-save program;
  3. Find out who owns your home (and find out if you are in foreclosure):
    1. from MERS:
    2. or from the County of Marin Assessor-Recorder's office (this could prove to be very important for you and our recommendation is to check this site weekly);
  4. Forensic Audit: We have learned that a Forensic Audit (a review of all of your original loan documents performed by a qualified professional) can turn the tide on how your lender treats you during the loan modification process. The audit will also aid in a decision to try for modification or take your lender to court (again, with a qualified professional).
  5. Produce the Note

  6. Service of Process
  7. If you must go to court:
    1. Code of Conduct for United States Judges. This form provides a checklist to identify potential conflicts of interest requiring recusal.
    2. The Buddy System. What to expect. How to conduct yourself.
  8. Lis Pendens
  9. Officials to contact regarding issues with your lender;
  10. Additional Steps You Can Take to Avoid Foreclosure.
