Documents Needed to Fight Foreclosure

Gather your financial papers.

Saving your home from foreclosure requires your active participation. it is a lot of work and can be very stressful for you and your family.

The home must be where you live. It must be a single family home, which includes a duplex, threeplex or fourplex. (If you have multiple properties, it may not be possible to assist you.)

Please make a file with the following papers . . .

  • COMPLETED WORKSHEET/BUDGET: For your first meeting with Marin Family Action;
  • BUDGET: Complete list of your income and all expenses (including daily purchases, i.e. coffee, transportation, magazines, clothes, cigarettes, alcohol, movies, lottery tickets.)
    • You will need copies of your:
      • Monthly utility bills
      • Monthly credit card statements
      • Monthly bank statements
    • HARDSHIP LETTER: Include a timeline of when your problems started. Write your own or use the Hardship Form from the Federal Government. We recommend obtaining a copy of your credit report to file with this letter;
    • CORRESPONDENCE FROM YOUR LENDER: DO NOT IGNORE YOUR LENDER. Track all contact with anyone you talk with regarding your home: Include date, time, phone number, name of person, location of office, badge number; Include foreclosure notices if you have them.
      • A copy of the Notice of Default and Notice of Sale: We need the name of the trustee;
      • A copy of the foreclosed "trustee's deed." Available at the County Recorder's Office.
  • INCOME VERIFICATION for the most recent available 30 days. For self-employed individuals, we need six months of income verification;
  • LAST TWO YEARS OF TAX RETURNS: W2's and 1099's. If self-employed, ou will need business tax returns for prior two years.
  • MONTHLY MORTGAGE STATEMENT: Most recent available;
  • PROPERTY TAX BILL: Most recent available;
  • HOMEOWNERS INSURANCE STATEMENT: Most recent available;
  • ALL LEGAL DOCUMENTS/CLOSING STATEMENTS: Ideally, you will have your entire closing package. This is extremely important, especially since you will probably want a forensic audit conducted. (Your title company can provide a duplicate set and may have it on disc for you.)
  • KNOW YOUR EXACT ADDRESS. Go to usps.gov, click on "find a zip code," type in your address. This is the address that Fannie Mae and Freddic Mac use. Please use this address.

We know the above is a lot of work and it can be frightening and/or embarrassing, but we are here to help; assessing your accurate financial position is needed. Millions of very fine, hard-working people are having a rough time with their finances. You are in excellent company!
